The decision of the Full Bench of the High Court in Kirk v Industrial Relations Commission of New South Wales; Kirk Group Holdings v Workcover Authority of New South Wales (Inspector Childs) [2010] HCA 1 (3 Feb 2010) has cast into some doubt the interpretation of the New South Wales Occupational Health and Safety Act 2000 (OHSA 2000 (NSW)) and throws a shadow over the continuing work of the Industrial Court of NSW in this important area of law. This paper examines the decision and discusses some implications of the decision.
